Agreement of the heirs of Nicholas Dawson of Deerfield Township, Warren County, Ohio who died 21 April 1867. Nicholas Dawson before his death had a farm of 170 acres in Deerfield Township, Warren County, Ohio and another farm of 200 acres in Clermont County, Ohio. Nicholas Dawson wife is Mary Dawson and his sons were Amos Dawson, Henry Dawson, Joshua Dawson, and Ezra Dawson deceased, and daughters Mary Dawson Irwin, Elizabeth Dawson McSears deceased, Matilda Dawson, and Catharine Dawson McKinney deceased. Elizabeth, Ezra and Catherine died before their father, Nicholas Dawson. Interesting note: Ezra Dawson and Catherine Dawson McKinney’s children must have died before Nicholas Dawson’s will since they are not listed as heirs in this estate dispute. Ezra Dawson’s children were Pingree Dawson,Rebech Dawson, Surbetius Dawson and Nicholas Dawson. Catherine Dawson McKinney’s children were James McKinney and John McKinney. Mary Irwin the wife of James Irwin is heir to Nicholas Dawson’s will and she and others are asking the courts to redistribute Nicholas Dawson’s estate on 24 June 1867. Note: James Irwin is the son of Robert Irwin and Lydia Cox Irwin and Mary Dawson Irwin the their daughter in-law.

Robert Irwin filed complaint on the Chancery side of Common Law in Warren County, Ohio vs James A.I. Lowes and others of Warren County, Ohio regarding land located in Deerfield Township, Warren County, Ohio in Section 27, Township 4, Range 2, on 5 July 1849. The land was subject to a lease upon property, as shown on Bills of Complaints in the favor of William Cox Irwin. On the 5 September1849, a right of partition was issued in the premises directed to the Sheriff of Warren County, Ohio commanding him to make a partition to the property by August Term 1849. The sheriff stated that the land could not be divided, without manifest an injury thereto, and that the Freeholders were appraised thirty one dollars per acre. William Cox Irwin, one of the parties was interested in the land appeared in court and elected to take said property at it’s appraised value. At the 1849 November Term of court , it was directed that the final decree to be entered in, the court adjudge to William Cox Irwin, his heirs and assign forever all and singular the real property foresaid at it’s appraised value, which the Court find amount to the sum of three thousand and six hundred and twenty four dollars and forty eight cents ($3,624.48) subject to the lease foresaid, that upon paying that sum, the said sheriff shall execute and deliver unto William Cox Irwin a deed, conveying to him the real property along with the improvement thereon on 8 December 1849.

Robert Irwin filed complaint on the Chancery side of Common Law in Warren County, Ohio vs James A.I. Lowes and others regarding land located in Deerfield Township, Warren County, Ohio in Section 27, Township 4, Range 2, on 5 July 1849. The first tract of land beginning at South West corner of John Lowes land containing 99 1/4 acres to the land of Peter Tetrick to Jonathan Whitaker’s land. The second track of land beginning at South East corner of the track of land owned by John Lowes containing 17 1/2 acres to Robert Irwin’s land to Jonathan Whitakers’ land to Peter Tetrick’s land. These two tracts are subject to a lease upon property, as shown on Bills of Complaints in the favor of William Cox Irwin. The subject to said lease, said real estate could be divided according to the law, amongst the several parties according to their respective rights. On the 5 September1849, a right of partition was issued in the premises directed to the Sheriff of Warren County, Ohio commanding him by the oath of the freeholders named therewith, he caused a partition to be made of the property and write to the court by August Term 1849. The sheriff stated that the land could not be divided, without manifest injury thereto, and that the Freeholders were appraised thirty one dollars per acre. The court entered their decree in the premises which recites substantially, that the right of partition had been by Sheriff duly executed. That William Cox Irwin, one of the parties was interested in the premises appeared in court and elected to take said property at it’s appraised value.
