Richard L. Irwin, William Harper Irwin, Flora E. Irwin Voorhis vs. Etta Irwin Miller and Charles Miller, her husband in Common Pleas, Warren County, Ohio on 5 May 1902. Law suit was regarding land division Section Section 34, Town 4, E.R. 2. N. 160 Acres & Section 20, Town 4, Range 2 between the Miami Rivers, 93 Acres in Deerfield Township, Warren County, Ohio from their mother, Sarah Harper Irwin’s estate. The law suit stems from disagreement on how to pay their mother, Sarah Harper Irwin’s debts after death, the feeling was that her personal property could settle her debts and that the children wanted division of their land inheritance. Since the land could not be divided equally between them without causing harm to the value of the land, Section 34, Town 4, E.R. 2. N. 160 Acres was sold at public auction to Finley Thompson for $9,855.00. Finley Thompson paid in full in cash. Section 20, Town 4, Range 2 between the Miami Rivers, 93 Acres was sold at public auction to Herman H. Krome for $3,791.00. Herman H. Krome paid in full in cash. After cost, each child received $3,317.01 from the auctions. The court record indicate that Section 20, Town 4, Range 2 between the Miami Rivers, 93 Acres was once owned by Robert Ross, deceased, set apart for him as on of the heirs of John Ross, deceased, by quick claim deed from William Willoughby and wife and William Ross and wife heirs at law of Joseph Ross, deceased. Sarah Harper Irwin was deeded this land by Frank Gallaher, Sheriff of Warren County, Ohio by deed dated, November 30, 1897 and recorded in Deed Book No. 79, Page 92 & 93 of Warren County Deed Records. Note: In 1875 William Cox Irwin, the husband of Sarah Harper Irwin owned 420 acres in Section 27 & 21 of Deerfield Township, Warren County. Ohio. Robert Irwin, the father of William Cox Irwin, owned 115.50 acres next door to them in Section 27.

Section 34, Town 4, E.R. 2. N. 160 Acres

Mentioned in law suit regarding division of Sarah Harper Irwin’s heirs land in 1902.  If appears that this land belonged to Robert Irwin her father in-law in 1875.  I would guess that after his death in 1875, he left this property to his son, William Cox Irwin who left it to his wife, Sarah Harper Irwin after his death in 1896.  The property was then left to the remaining living children after their mother, Sarah Harper Irwin died in 1901, (Richard L. Irwin, William Harper Irwin, Flora E. Civil Action to Rescina Contract (release parties from further obligations to each other) on 21 September 1869 in Warren County, Ohio by petitioner Amos Dawson, Matilda Dawson, Joshua Dawson, Henry Dawson and Mary Dawson vs defendants Mary Irwin and James Irwin her husband, Susannah Elliott and John Elliott her husband, John H. McKinney and James McKinney, Mary A. Kaneer and Isaac Kaneer her husband, John W. Vanleer and Henry Vanleer, Rebecca Dawson, Senetus Dawson, Nicholas Dawson and Pingree Dawson. On 10 November 1870 the case was dismissed without prejudice and without record at continue of plaintiffs.

William Irwin, deceased, will dated 5 May 1849 was brought before March Term 1857, in open court in Warren County, Ohio by Thomas M. Skinner and Hamilton H. Cox dated 5 May 1849.

I, William Irwin being in my right mind, and about to start on a long journey think it my duty to make this my last Will and Testament. First I will my soul to God who gave it, Second all my just debts to be paid. Third I will my Estate to be  divided equally between James Irwin, my brother and Jane Miller, and her heirs that is my sister and her heirs.

Estate of Thomas H. Irwin, deceased, January Term, 1897, Proceeding for Sale of Real Estate. William C. Hankinson his father in-law is administrator of his estate. Thomas H. Irwin’s children, Sarah A. Irwin and John W. Irwin are minors under 14 years of age. Will Hankinson is their legal guardian. Sarah A. (Hankinson) Irwin is Thomas H. Irwin’s wife. William Hankinson testifies that the allegations in the application for probate are true as he verily believes. H. J. Death and P.H. Rue attached to said Will, testify in writing of the last will and testament of Sarah A. Irwin was duly executed and attested; and that she was of sound mind and memory, and any restraints. 

Sarah A. Irwin mentions her parents, Hannah J. Hankinson and William C. Hankinson.   She signed her will 28 April 1909.

Will of Robert J. Irwin, died on 13 November 1925, resident of Deerfield Township, Warren County, Ohio. R.J. died leaving Annie I. (Duvall) Irwin his widow resides at Mason and following named persons his only next of kin. Etta (Irwin) Miller his half sister, William Harper Irwin his half brother, Laura Irwin his half sister. Estate of Oliver P. Irwin, deceased, died August 1879, late resident of Franklin Township, Warren County, Ohio. On 14 January 1887, John Irwin from Blue Ball, Ohio produced in open court for admission to probate and record a paper writing purporting to be the last will and testament of Oliver P. Irwin. John stated that Oliver left no widow and he is his brother and only next of kin residing in State of Ohio. In Oliver P. Irwin’s will he first states that all of just debts and funeral expenses be paid. Second, he will and bequeath to his sister, Martha Irwin all my half of 77 acres of land in Range 4 Town 2, Section 9 in Lemon Township, Butler County, Ohio and also all my personal effects. In testimony thereof I have set my hand and seal this 14 August 1879.
